Tallahasseeans Look to Chattanooga

If you are out and about Tuesday and see 26+ people who look like they are on a guided tour of the riverfront and downtown smile and be on your best behavior! 

According to Tallahassee.com David Ramsey (former Chattanooga resident) will be showing off our beautiful downtown and riverfront area to a group of leaders from Tallahassee.  They will be looking at what we have done to revitalize the area with a mind to do some of the same things in their area.

I wonder if they thought about the fact that Riverbend would be going on Tuesday.



May Residential Chattanooga MLS Stats

I waited a few more days into the month to pull stats this time to allow time for all the month end activity to be input.

Statistically things are about the same as last month with a small decrease in available inventory.  This figure needs to be in the 4 month range but 7.45 is an improvement over last months 8.55. 

Compared to May 2006 things are still not looking very good.  We had a decrease in number of sales while seeing a rather large increase in inventory.  The number of days a home is on the market continues to be in triple digits.  Almost double the same time last year.

Riverbend Festival along the 21st Century Waterfront in downtown. Riverbend features six stages along the one mile riverfront festival site with a wide variety of entertainment, fireworks, Starfighter jet flyovers, 5 & 10K Races and a Children’s Village. Festival admission pins are available at all area Favorite Markets & Fast Food & Fuel convenience stores through June 7 for $28. June 8 and after at the festival gates and at all Favorite Markets & Fast Food & Fuel locations for a general admission price of $36. One-Day wristbands, which can only be purchased at the gates, are $23. Seniors 60 and older pay half price on the one day wristbands. Children 10 and under are admitted free.

Time for Riverbend!

Chattanooga Riverbend FestivalIt’s that time of year again.  Time for 100,000 plus festival goers to swarm the downtown Chattanooga area. Do you have your Riverbend pin?  The schedule looks great this year!

If you aren’t familiar with the Riverbend Festival, its’ nine days of fun and partying downtown along the river.  Several stages set up with all types of music from country, to rock, to blues, to gospel.  Lots of food and fun!

Riverbend 2007 starts tonight with Craig Morgan and Blake Shelton kicking off the Coca-Cola stage at 9:30.  Faith and Family night is going to be held Tuesday with Phil Stacey of American Idol fame opening up for Jars of Clay.  Of course, the Bessie Smith Strut (Blues and BBQ) will be Monday night.  This year the hours for the strut have been extended.  Randy Owen will close the festival with his performance on the Coca-Cola stage at 9:30.  Immediate following him will be the fireworks show.  Always a favorite.

It’s going to be a great time for everyone.



Article 10-Shades of Gray

Duties to the Public

Article 10
REALTORS® shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, or national origin. REALTORS® shall not be parties to any plan or agreement to discriminate against a person or persons on the basis of race, color, religion, sex, handicap, familial status, or national origin. (Amended 1/90)

REALTORS®, in their real estate employment practices, shall not discriminate against any person or persons on the basis of race, color, religion, sex, handicap, familial status, or national origin. (Amended 1/00)

  • Standard of Practice 10-1
  • When involved in the sale or lease of a residence, REALTORS ® shall not volunteer information regarding the racial, religious or ethnic composition of any neighborhood nor shall they engage in any activity which may result in panic selling, however, REALTORS® may provide other demographic information. (Adopted 1/94, Amended 1/06)

  • Standard of Practice 10-2
  • When not involved in the sale or lease of a residence, REALTORS ® may provide demographic information related to a property, transaction or professional assignment to a party if such demographic information is (a) deemed by the REALTOR® to be needed to assist with or complete, in a manner consistent with Article 10, a real estate transaction or professional assignment and (b) is obtained or derived from a recognized, reliable, independent, and impartial source. The source of such information and any additions, deletions, modifications, interpretations, or other changes shall be disclosed in reasonable detail. (Adopted 1/05, Renumbered 1/06)

  • Standard of Practice 10-3
  • REALTORS ® shall not print, display or circulate any statement or advertisement with respect to selling or renting of a property that indicates any preference, limitations or discrimination based on race, color, religion, sex, handicap, familial status, or national origin. (Adopted 1/94, Renumbered 1/05 and 1/06)

  • Standard of Practice 10-4
  • As used in Article 10 “real estate employment practices” relates to employees and independent contractors providing real estate-related services and the administrative and clerical staff directly supporting those individuals. (Adopted 1/00, Renumbered 1/05)

    This is a pretty lengthy article but its actually simple.  It’s all about Fair Housing.  If a question or remark comes up in any way regarding any of the protected classes (race, color, religion, sex, handicap, familiar status or national origin) it’s taboo. 

    A lot of people will say we are not to discuss any of these subjects ever.  Well, there is also a contingent that says if I am buyers representative I have a responsibility to assist my client in buying a home in a neighborhood that has the type of community they want.  For example: my buyer client tells me they want to live in a neighborhood of individuals of the same religious belief (such as a Jewish community) would it be a violation of my fiduciary duty not to help them find a home in a Jewish community?  They are not telling me they don’t want to live in a particular area but that they do.  Something to think about…



    Article 9-Get it in Writing

    Article 9
    REALTORS®, for the protection of all parties, shall assure whenever possible that all agreements related to real estate transactions including, but not limited to, listing and representation agreements, purchase contracts, and leases are in writing in clear and understandable language expressing the specific terms, conditions, obligations and commitments of the parties. A copy of each agreement shall be furnished to each party to such agreements upon their signing or initialing. (Amended 1/04)

  • Standard of Practice 9-1
  • For the protection of all parties, REALTORS® shall use reasonable care to ensure that documents pertaining to the purchase, sale, or lease of real estate are kept current through the use of written extensions or amendments. (Amended 1/93)

  • Standard of Practice 9-2
  • When assisting or enabling a client or customer in establishing a contractual relationship (e.g., listing and representation agreements, purchase agreements, leases, etc.) electronically, REALTORS ® shall make reasonable efforts to explain the nature and disclose the specific terms of the contractual relationship being established prior to it being agreed to by a contracting party. (Adopted 1/07)

    Put it in writing and make sure everyone is on the same page!  If it’s not in writing then it means nothing.  This is why you should never negotiate a verbal offer, verbal repairs, verbal anything.  If it’s in writing and everyone has signed then there is no chance for miscommunication.

    Article 8-Where’s the Money?

    Article 8
    REALTORS® shall keep in a special account in an appropriate financial institution, separated from their own funds, monies coming into their possession in trust for other persons, such as escrows, trust funds, clients’ monies, and other like items.

    All money received in trust for clients and customers must be kept in a special account that is totally separate from any other accounts the firm may have.  That money is not to be touched for any reason other than it’s intended purpose.  This account is closely audited by the state.
